Terms of service
1. GENERAL
1.1 TFGM Watches operates as a professional seller of vintage and pre-owned watches.
1.2 By placing an order, making a payment, or entering into any agreement with TFGM Watches, the customer agrees to these Terms of Service.
1.3 Any deviation from these terms is only valid if explicitly agreed upon in writing.
2. CONDITION OF THE WATCHES
2.1 All watches offered by TFGM Watches are vintage or pre-owned, unless explicitly stated otherwise.
2.2 Vintage watches inherently show signs of age and use, which may include but are not limited to:
• wear to the case and/or bracelet
• patina or discoloration of lume or dial
• visible scratches
• stretch in metal bracelets
2.3 Any notable characteristics are described to the best of our knowledge and shown in photographs.
2.4 The buyer acknowledges that vintage watches are not comparable to new watches.
3. WATER RESISTANCE
3.1 TFGM Watches provides no guarantee regarding water resistance, regardless of condition, age, or service history.
3.2 Water resistance is always excluded from any form of warranty or liability.
3.3 Any exposure to water is entirely at the buyer’s own risk.
4. FUNCTIONALITY & SERVICING
4.1 Unless explicitly stated otherwise:
• the movement has been checked for basic functionality
• the watch operates within acceptable vintage tolerances
4.2 Vintage watches may require servicing at any time, even when functioning correctly.
4.3 Any future maintenance or service costs are the sole responsibility of the buyer, unless agreed otherwise in writing.
5. WARRANTY
5.1 No manufacturer warranty applies to vintage or pre-owned watches.
5.2 Any optional TFGM Watches warranty must be agreed upon in writing and may involve additional costs.
5.3 Without such agreement, the following are excluded from warranty:
• normal wear and tear
• damage caused by impact or misuse
• moisture or water damage
• internal wear or future defects
6. AUTHENTICITY
6.1 All watches are checked for authenticity by TFGM Watches.
6.2 TFGM Watches guarantees the authenticity of the case, dial, hands, and movement unless explicitly stated otherwise.
6.3 Any aftermarket or replacement parts are always disclosed prior to sale.
7. SALE TO PRIVATE CUSTOMERS
7.1 Watches are sold under the Dutch margin scheme for second-hand goods, unless stated otherwise.
7.2 Private buyers are entitled to an honestly and accurately described product. This does not affect the buyer’s statutory rights under Dutch consumer law. No manufacturer warranty applies unless explicitly stated.
8. RIGHT OF WITHDRAWAL (HERROEPINGSRECHT)
8.1 The statutory right of withdrawal applies exclusively to consumer purchases concluded at a distance, such as transactions completed via the website or other forms of remote communication, in accordance with applicable Dutch law.
8.2 The statutory right of withdrawal does not apply to purchases concluded in person, where the buyer has had the opportunity to physically inspect the watch prior to completing the transaction.
8.3 Each watch may show signs of age and use. Such characteristics are not grounds for withdrawal or cancellation of the purchase, provided they have been accurately described and clearly visible in the listing and/or product images.
8.4 Transactions involving part exchange agreements and/or purchases concluded during in person meetings do not fall under the statutory right of withdrawal.
9. RETURNS & REFUNDS
9.1 For distance purchases, consumers have a statutory right of withdrawal of 14 days in accordance with Dutch consumer law. The withdrawal must be notified in writing within 14 days of delivery.
9.2 A return is accepted only if the watch is returned in the same condition as delivered, unworn, unaltered, and with all original accessories, documentation, and packaging included.
9.3 Shipping costs, service costs, transaction fees, and any loss in value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the watch may be deducted from the refund.
9.4 The right of withdrawal does not apply, or may be refused, if the watch shows signs of wear, water damage, shock damage, has been opened or modified by a third party, or differs from the condition in which it was delivered.
10. PAYMENT & RETENTION OF TITLE
10.1 All watches remain the property of TFGM Watches until the full purchase amount has been received.
10.2 In case of late or incomplete payment, TFGM Watches reserves the right to:
• suspend or cancel the agreement
• reclaim the product
• charge statutory interest and collection costs
10.3 All judicial and extrajudicial collection costs resulting from non-payment shall be borne by the buyer.
11. SHIPPING & RISK
11.1 Insured shipping is strongly recommended.
11.2 If shipment is uninsured, all risk transfers to the buyer at the moment of dispatch.
11.3 For insured shipments, coverage is limited to the terms and conditions of the shipping insurer.
12. COMPLAINTS PROCEDURE
12.1 Any complaints must be submitted in writing via email or WhatsApp within a reasonable time after discovery of the issue.
12.2 The buyer must allow TFGM Watches a reasonable opportunity to investigate and resolve the complaint before taking further action.
12.3 Complaints submitted after delivery that fall within normal vintage characteristics do not constitute a valid claim.
13. LIABILITY
13.1 TFGM Watches is not liable for:
• damage caused by improper use
• water or moisture damage
• loss or theft after delivery
• normal wear or aging
• future service requirements
13.2 Any liability is strictly limited to the purchase price of the watch.
14. FORCE MAJEURE
14.1 TFGM Watches is not liable for failure to perform obligations due to force majeure, including but not limited to:
• strikes
• transport disruptions
• technical failures
• extreme weather conditions
• government measures
14.2 In such cases, TFGM Watches reserves the right to suspend or terminate the agreement without liability.
15. PRICING & TYPOGRAPHICAL ERRORS
15.1 All prices are subject to change and availability.
15.2 Obvious typographical or pricing errors do not bind TFGM Watches and may result in cancellation of the agreement.
16. PRIVACY & DATA PROTECTION (AVG / GDPR)
16.1 Personal data is processed solely for order handling, communication, and legal obligations.
16.2 Data is not shared with third parties unless strictly necessary for execution of the agreement or required by law.
16.3 TFGM Watches complies with applicable GDPR regulations.
17. AMENDMENTS
17.1 TFGM Watches reserves the right to amend these Terms of Service at any time.
17.2 The most recent version published on the website shall apply.
18. GOVERNING LAW
18.1 All agreements are governed exclusively by Dutch law.
18.2 Any disputes shall be submitted to the competent court in the Netherlands.
